Section 10 warns against the unlawful handling or possession of devices, including computer programs, specifically designed or adapted for committing offenses. This encompasses tools or software created with the intent of causing harm or engaging in criminal activities.

Imagine someone who possesses a specially designed program that enables unauthorized access to secure computer systems. This program could potentially be used for hacking or stealing sensitive information, making it a tool with the potential for serious harm.


Facing the Consequences:


Any breach of Section 10 is considered a significant offense. Those convicted may face a substantial fine, not less than ten million shillings, or three times the value of the undue advantage received, whichever is greater. Alternatively, they could be sentenced to imprisonment for a minimum of three years, or both.
